Public transportation and car ownership is another alternative but it may be costly due to the rising fuel prices. In the other traditional car rental companies the customers have to wait for long to get their car. By using Zipcar they can find a nearby car witho ut waiting which is more convenient. In addition, Zipcar has an established brand name and a strong identity which makes the customers more attached to it. With a unique service and an established brand name Zipcar customers cannot be high on price sensitivity and their bargaining power is reduced. Concerning the bargaining power of suppliers, most of the suppliers for Zipcar are not concentrated. Insurers, gas providers and car agencies can be considered among the suppliers of Zipcar. All of these work in competitive markets. There are several insurers, car agencies and gas providers and Zipcar can chose among them which makes the bargaining power of suppliers low. However, Zipcar needs parking spaces and auto services which can be beneficial for the supplier. Parking spaces can be owned by a government authority or a business establishment. Zipcar may need to build and maintain relationships with these entities to get the parking spaces especially if the government or the establis hment owns a huge parking area. This way the supplier might have the upper hand since Zipcar needs those spaces near the customers. Also, the cars that Zipcar uses need services which makes the company limited to a very few suppliers to provide this service. SO YOU WANT TO BE A NAVY SEAL? From Sea, Air, and Land, the U.S. Navy Seal Teams are the most feared and respected commando forces in the U.S military if not the world. The Seal Teams are the most elite and highly trained forces on the face of the earth. President John F. Kennedy formed the teams in 1962 as a seagoing counterpart to the U.S Army Special Forces. Most Seal missions are unreported and unknown to the general public. The Seals are trained to operate in small units, one or two men, or a platoon consisting of sixteen or more men. Not all Seal teams are made for everyone, in fact 80% of the men who attempt to become one, fail or will drop out. To become a Seal you must have dedication, hardwork, and a lot of commitment. The process of becoming a seal is broken down into three different phases, Phase 1, Phase 2, and Phase 3. ââ¬Å"The first phase starts with a bang and ends with a boom,â⬠says Travis Schweizer, a twenty-three year-old Seal. Phase 1 consists of a two and three-mile timed run, physical training, one to two mile ocean swims, and a gut burning obstacle course. These items are a part of everyday delight for these men. Phase 1 lasts for approximately eight weeks and that is only if you do not get set back. The First five weeks the studentââ¬â¢s learn life saving, knot tying, underwater knot tying, basic first aid, and surf passages in small inflatable boats. Along with this is a 50-yard underwater swim, which must be completed and the students are often revived when they pass out. Also throughout out the whole six months of BUD/S (Basic Underwater Demolition School), the Seal Teams go through many torturous events and lessons. One of these being surf torture. This is where the entire class must wade into the surf zone to their waistline, then sit down with arms linked. Just to let you know the water in Coronado, California never gets above sixty-eight degrees during the summer and fifty-eight degrees during the winter. There the men with linked arms will sit there for hours at a time, soon the cold sucks out all of their body warmth and the whole class is shivering in unison as the waves crash over there heads. After this the men will find themselves doing hours of calisthenics to warm up, only to go back in the cold water for a few more hours. This is a very effective way to teach a potential Seal to mentally resist the effects of hypothermia,... ...o the students who are in SEAL training, but have not yet completed all 3 phases). The twenty or so men who graduate with stern faces and hardened bodies, show little resemblance to the wide eyed kids who arrived on the quarter-deck six and half months earlier to set sail on the journey of a lifetime. The moment of reflection and rest is short lived though. For now it is off to jump school, then assigned to a Seal team on the East or West Coast. Once on the Seal Team, it becomes clear that training has just begun. From now on they must prove worthy of wearing the coveted ââ¬Å"Tridentâ⬠Naval Warfare emblem. Once at Jump School these determined men will now start learning the proper techniques of jumping out of a perfectly good plane. This is known as Post BUD/s training. Thai Labour Law on Employment Termination
ââ¬Å"If the parties have not fixed the duration of the contract either party can terminate it by giving notice at or before any time of payment to take effect at the following time of payment. But no more than three-month notice need be given. ?â⬠The employer can, on giving such notice, immediately dispense with the services of the employee by paying him his remuneration up to the expiration of the noticeâ⬠Section 17, paragraph two ââ¬â of the Labour Protection Act: Where the employment contract is of no specific duration, the employer or the employee may terminate the employment contract by giving an advance notice in writing to the other party on or before the date fixed for a payment of wages so that the termination of the employment contract takes effect on the date fixed for the next succeeding payment of wages, provided that the advance notice need not be of a period exceeding three months. Compensation for Termination of Employment: Upon terminating an employe e, the employer is required to pay compensation to the employee whose amount depends on the length of the employee's service towards the employer. Periods of employmentAmounts of severance payment An employee who has consecutively completed 120 days, but less than one (1) year, of work:a payment of not less than 30 days of his or her last wages, or, in the case of an employee who works on a piecemeal basis, not less than the wages of his or her last 30 days of work. Before the termination of an employment is to take effect, the employer needs to notify his employee in writing on or prior to a wage payment date so that the termination takes effect on the succeeding wage payment date. However, the period of an advance notice need not be more than three (3) months. Unfair Termination 5. 1 Section 49 ââ¬â Act on the Establishment of the Labour Court and Labour Procedure, B. E. 2522 (A. D. 1979) Besides the payment of severance pay, an employer may be ordered by the labour court, upon the employee's request to t pursuant to Section 49, either to reinstate the dismissed employee or to pay damages to him or her if it is found that the dismissal is unfair Section 49 provides: ââ¬Å"In the trial of a case of dismissal of an employee by an employer, if the labour court is of the opinion that such a dismissal is not fair to the employee, the labour court may order the employer to accept the said employee to work at the rate of wage payable at the time of dismissal. If the labour court is of the opinion that the employer and the employee cannot work together any longer, the labour court shall fix the amount of damages as compensation to be paid by the employer by taking into consideration the age of the employee, the length of employment of the employee, the hardship of the employee at the time of dismissal, cause of the dismissal and the compensation to which the employee is entitled. â⬠Thai Supreme Court Judgment No. 574/2526 An employee had committed 11 counts of wrongdoings some of which warranted a dismissal by the employer and denied the wrongdoer necessary protection under the labour law. The employer did not dismiss the employee in question by reason of the wrongdoing, but elected to impose a lighter disciplinary action against him. Subsequently, the employer decided to dismiss the employee after he failed to report to work for one day. Apparently, the dismissal was also made in reliance on the employee's previous wrongdoings. The court held the dismissal as an unfair termination of employment because the employer was believed to have no intention in penalising (i. e. dismissing) the employee at the times the past wrongdoings occurred. Therefore, the employer could no longer rely on the past wrongdoings to dismiss the employee again. Summary of What Constitutes an Unfair Termination. In addition, on the basis of court judgments, an unfair termination of employment may be summarised to include (i) a dismissal without cause, or with cause but such cause is unreasonable, or (ii) it is not to such an extent as to warrant a dismissal, or (iii) it lies outside a company's work rules or an employment contract, or (iv) a dismissal in which an alleged offence of an employee cannot be proved or in which an employee has committed no offence, or (v) a dismissal which is intended to harass or persecute an employee.
